工作经历

大学期间及其后高琳律师就职于北京通商律师事务所和美国宝维斯律师事务所北京办事处,1995年赴美留学,1996年获美国圣路易大学法学院硕士学位,并获得美国纽约州执业律师资格。1996年至2000年,高琳律师曾先后就职于名列美国前十强的两家大型国际律师事务所(美国圣路易博闻律师事务所和达拉斯艾金·岗波律师事务所),从事诉讼、国际仲裁、公司法和融资等方面的法律事务。2000年加入北京市世嘉律师事务所。

主要工作履历

●1994年,北京通商律师事务所,负责起草各种中英文合同及法律文书;

●1995年,美国宝维斯律师事务所北京办事处,负责起草中英文合同、法律意见书等各种法律文书;

●1995至1996年,就读于美国圣路易大学法学院,获法学硕士学位,主读方向为国际贸易投资法、公司法、房地产法、合同法、国际仲裁法及美国司法体系;

●1995至1997年,美国圣路易博闻律师事务所,参与基金投资、国际贸易和投资、收购与嫌并、反倾销、国际商务诉讼与仲裁、投资项目可行性研究、合同谈判和起草、公司并购、企业设立与注册等工作。

●1997至2000年,达拉斯艾金·岗波律师事务所,从事公司法、合同法、基金投资、国际贸易投资、房地产、金融、商业贸易、税务、收购与嫌并、反倾销、商业诉讼与国际仲裁。

●1998年,美国达拉斯参加为6个星期的国际比较法和国际仲裁法律专题研讨班,参加者为各国著名律师、法官及法学界名流。

●高琳律师曾多次被邀请参加国家经贸委、轻工总会、天津市委等机构联合主办的包括反倾销和WTO等议题在内的各类全国性或国际性研讨会,并在与会期间发表精彩演讲。

●在反倾销方面,高琳律师有着丰富的实战经验和优秀的业绩,曾代理过大量对美国及欧盟反倾销案件,其中决大多数案件以低税率或无损害获胜。

比较具有代表性的案件有:

1.代理马鞍山钢铁公司处理美国商务部和国际贸易委员会H型钢反倾销应诉事务,获得零税率;

2.代理山东潍坊钢管公司处理美国商务部和国际贸易委员会焊接钢管反倾销案应诉事务,取得零税率;

3.代理湛江丰源水产有限公司参加美国商务部冷冻暖水虾反倾销案新出口商复审,取得零税率;并在第五、六、七次行政复审调查,取得零税率,后该企业因连续3次获得零税率,美国商务部取消了对该企业的反倾销令,这是历史上最后一家通过参加行政复审连续三个零税率被取消反倾销令的企业;

4.代理中国某钢丝绳厂处理美国商务部和国际贸易委员会钢丝绳反倾销应诉事务,获得零税率;

5.代理一家江苏民营钢管企业参加印度无缝管双反案件,无税结案;

6.代理一家山西民营钻杆企业参加美国商务部钻杆反倾销案,获得零税率;

7.代理一家山西民营钻杆企业参加美国钻杆反补贴复审,将税率从18.18%降至5.07%;

8.代理一家石油管材出口企业参加美国商务部对石油管材反补贴复审,将其补贴税率从13.41%降至1.84%;

9.代理一家石油管材企业参加加拿大对石油管材反补贴复审。最终结果为每吨产品54 元补贴,补贴率近乎0;

10.代理一香港公司处理美国商务部和国际贸易委员会折叠礼物纸盒反倾销案应诉事务,获得零税率;

Working experiences 

During and after college, lawyer Gao Lin worked in Beijing Commerce & Finance Law Offices and Paul Weiss Rifkind Wharton & Garrison Beijing Office. In 1995, she went to the United States for further education. In 1996, she received a Master's Degree from the Law School of Saint Louis University and acquired a practicing lawyer qualification in New York State. From 1996 to 2000, she successively engaged in legal affairs in litigation, international arbitration, company law and financing at Bryan Cave Leighton Paisner LLP in St. Louis and Akin Gump Strauss Hauer & Feld LLP in Dallas, both of which are among the Top 10 largest international law firms in the United States. In 2000, she joined Beijing Goodwill Law Firm.

● In 1994, she was mainly responsible for drafting contracts and legal documents in Chinese and/or English in Beijing Commerce & Finance Law Offices;

● She has rich practical experiences and excellent performance in anti-dumping area. She has represented a large number of anti-dumping cases against the United States and the European Union, including the vast majority of cases that won with low tax rates or no damage. 

More representative cases are:

1. Representing Ma'anshan Iron and Steel Company in the antidumping investigation aganist H-shaped steel from China initiated by U.S. Department of Commerce and International Trade Commission, obtaining zero rate;

2. Representing Shandong Weifang Steel Pipe Co., Ltd. in the anti-dumping investigation against welded steel pipes from China initiated by U.S. Department of Commerce and International Trade Commission, obtaining zero rate;

3. Representing Zhanjiang Regal Integrated Marine Resource Co., Ltd. in anti-dumping reviews against frozen and warm water shrimp from China initiated by the U.S. Department of Commerce, and getting zero rate in the New-Shipper Review, the 5th,6th and 7th administrative review, and the the antidumping order was revocken for this Client because the Client got zero rate in three successive administrative reviews.

4. Representing a steel wire rope factory in China in the antidumping investigation initiated by othe US Department of Commerce and the International Trade Commission for steel wire rope, obtaining zero rate;

5. Representing a private steel pipe enterprise in Jiangsu in the antidumping and countervailing investigations against seamless steel pipes initiated by Indian Government and the cases ended with no duty. 

6. Representing a private drill pipe manufacturer in Shanxi in the antidumping investigation against drill piples from China initiated by the U.S. Department of Commerce and the Client got zero rate. 

7. Representing a private drill pipe manufacturer in Shanxi to participate in the countervailing review against drill pipes from China, and decreasing the rate for this Client from 18.18% to 5.07%;

8. Representing an Oil CountryTubular Goods exporter in the countervailing review initiated by the U.S. Department of Commerce, and decreasing the subsidy rate from 13.41% to 1.84%.

9. Representing an Oil CountryTubular Goods enterprise in the countervailing review initiated by Canadian Border Services Agency and the Client got a rate of CNY 54 per MT of pipes, and the subsidy rate is close to zero.

10. Representing a Hong Kong company in the antidumping investigation against folded gift carons from China initiated by the U.S. Department of Commerce and the International Trade Commission on Folded Gift and obtaining a zero duty rate;

11. Representing a Chinese apple juice exporter in the anti-dumping cases of concentrated apple juice initiated by U.S. Department of Commerce and International Trade Commission, and obtainign a zero rate;

12. Representing Jinan Meide in the anti-dumping investigation against cast iron pipe fittings from China initated by the U.S. Department of Commerce and the International Trade Commission, and obtaining a low duty rate;

13. Representing 5 Chinese enterprises in the anti-dumping investigation against brake disc from China initiated by U.S. Department of Commerce and International Trade Commission, obtaining zero rate and average tax rates;

14. Representing Wanxiang Group in the anti-dumping investigation against ball bearings from China initiated by U.S. Department of Commerce and International Trade Commission, the tax rate obtained was lower than the average tax rate;

15. Representing TCL Corporation in the anti-dumping investigation against color TV sets from China initiated by U.S. Department of Commerce and International Trade Commission, and obtained a lower duty rate than the average one;

16. Representing Dalian Guangming Furniture and other enterprises in the anti-dumping investigation against wooden bedroom furniture from China initiated by U.S. Department of Commerce and International Trade Commission;

17. Representing Shandong Naoshan Paper Group in the anti-dumping investigation against sponge paper from China initiated by U.S. Department of Commerce and International Trade Commission, the preliminary result obtained China's lowest tax rate of 9%, other companies which we didn’t act as agency obtained tax rate higher than 90%;

18. Representing Hengxing Aquatic Products, Fengyuan Regal Marine Resources, Maoming Changxing Food Company in the anti-dumping investigation against frozen shrimp from China initiated by U.S. Department of Commerce and International Trade Commission, among which Fengyuan Regal Marine Resources participated in the review as new exporter and obtained zero tax rate, which was the first company in China to obtain zero tax rate in the administrative review case;

19. Representing nearly 20 Chinese enterprises in the anti-dumping investigation against diamond saw blades from China initiated by U.S. Department of Commerce and International Trade Commission, obtaining average rate;

20. Representing Nantong Haidi Chemical Co., Ltd. in the anti-dumping investigation against Permanent Violet 23 from China initiated by U.S. Department of Commerce and International Trade Commission, obtaining zero rate;

21. Representing 4 Chinese enterprises in the anti-dumping investigation against notebooks from China initiated by U.S. Department of Commerce and International Trade Commission, obtaining average rate;
